These Terms and Conditions of Use (“Terms”) govern your access to and use of the Generational Gifting Concept® websites, pages, tools, forms, scheduling features, educational resources, and related online services (collectively, the “Platform” or “Site”), operated by Generational Gifting Inc., a New York corporation (“GGI,” “we,” “us,” or “our”).
By accessing, browsing, or using the Platform, or by submitting information through any Platform form, you agree to be legally bound by these Terms and our Privacy Policy (defined below). If you do not agree, do not use the Platform.
“Privacy Policy” means GGI’s online privacy policy/notice posted on the Platform (as updated from time to time), which is incorporated into these Terms by reference.
1. Important Disclosures (PLEASE READ)
The Platform is an educational planning framework and technology-enabled informational resource. The Platform is designed to support general education regarding long-term planning concepts and multi-generational gifting concepts.
1.1 No Financial, Tax, or Legal Advice
The Platform and all content provided through it are for general educational and informational purposes only and do not constitute: financial advice, investment advice, tax advice, legal advice, insurance advice, fiduciary advice.
You are solely responsible for your decisions and actions, including any financial, insurance, or planning decisions you make. You should consult your own professional advisors (including your own attorney, tax advisor, and licensed insurance professional) before making any decisions.
1.2 No Offer or Solicitation
Nothing on the Platform constitutes an offer, solicitation, recommendation, or inducement to purchase any insurance product, financial product, or service. Any insurance product discussion is educational and subject to state licensing requirements, carrier approval, underwriting, and applicable law.
1.3 Insurance Products Are Issued by Carriers
Any insurance products referenced are issued solely by third-party licensed insurance carriers. Product features, availability, performance, costs, benefits, and terms vary by insurer and state. Approval and pricing are determined by the issuing carrier.
1.4 No Guarantee of Results
The Platform does not guarantee outcomes, approval, rates, cash values, dividends, policy performance, tax treatment, financial results, or suitability. Any examples are for illustration and education only, and results vary.
2. NOT AN INSURANCE AGENCY / NOT A BROKER / NOT AN MGA / NO FIDUCIARY
GGI is not acting as: an insurance agency, an insurance broker, a managing general agent (“MGA”), an insurer, an investment adviser, a broker-dealer, a fiduciary, a financial planner providing individualized recommendations.
GGI does not negotiate insurance terms, quote binding premiums, underwrite policies, or issue insurance products.
Insurance products, if discussed, are offered only through properly licensed insurance professionals and issued by third-party insurers, subject to underwriting and carrier approval.
2.1 Carrier Independence + No Endorsement
Insurance carriers are independent third parties. Carriers don’t sponsor or endorse the Site. Practitioners are independent contractors and not agents of GGI. Carrier products vary by state and underwriting.
3. Access and Security
You should be aware that, in general, information sent through the Internet is not secure. Email communications are generally not encrypted and do not provide a secure or private means of communication. While the Platform may use reasonable administrative, technical, and organizational safeguards designed to protect information, we cannot guarantee that any information transmitted through the Internet will be secure or that such transmissions will be free from delay, interruption, interception, or error. You should not transmit sensitive personal information through email or other unsecured channels.
We cannot guarantee or warrant that any part of the Platform, including files available for download, will be free of viruses, malware, or other harmful code. It is your responsibility to implement appropriate safeguards, including the use of antivirus software, firewalls, and other protective measures, to protect your device, systems, and data.
4. Who May Use the Site (Eligibility)
You must be at least 18 years old to use the Platform. The Platform is not intended for use by children under 13. We do not knowingly collect personal information directly from children under 13. By using the Platform, you represent that you are legally able to form a binding contract and are not prohibited from using the Platform under applicable law.
Child-Related Information. The Platform may allow adult users to provide non-identifying information related to family structure or planning goals (for example, number of children being gifted for). Users must not submit any child’s personal information through the Platform, including a child’s full name, date of birth, Social Security number, address, school, medical information, or any other identifying information. Any child-related information submitted is provided solely by the adult user for educational planning and intake purposes and is not intended to identify or create an account for any child.
If you submit information about another person, you represent that you have legal authority to do so and consent to provide such information.
5. Requesting Contact with a GGC Practitioner
The Site may allow you to request contact with a Generational Gifting Concept® Practitioner (“Practitioner”) by submitting your information (a “Request”).
By submitting a Request, you acknowledge and agree that:
You are requesting an educational conversation, not financial, legal, tax, or insurance advice.
Submission does not create a client relationship, advisor relationship, fiduciary relationship, or insurance producer relationship with GGI.
Any insurance-related implementation discussions are handled only by appropriately licensed professionals in a separate capacity and subject to state law and carrier rules.
GGI does not guarantee that a Practitioner will be available in your state, that you will qualify for any insurance product, or that any outcome will occur.
5.1 No Duty; No Professional Relationship. Use of the Platform does not create any professional relationship, duty of care, or obligation between you and GGI, including any advisory, brokerage, fiduciary, insurance producer, or attorney-client relationship.
5.2 GGI does not guarantee response times, scheduling availability, or that any Practitioner will contact you within any specific timeframe.
6. Errors, Inaccuracies, and Omissions
We strive to provide accurate, complete, and up-to-date educational information on the Platform. However, the Platform and its content may occasionally contain typographical errors, technical inaccuracies, omissions, outdated information, or other mistakes, including information relating to educational content, descriptions of services, availability of features, or general planning concepts.
We do not guarantee the accuracy, completeness, reliability, or timeliness of any information made available through the Platform, and we assume no responsibility for any reliance placed on such information by any user.
We reserve the right to correct, update, modify, or remove any content at any time, without notice. Your use of the Platform and reliance on any information provided through the Platform is at your own risk.
The Platform provides general educational information only and does not provide individualized insurance, financial, legal, tax, or investment advice. Users should not rely on Platform content as a substitute for advice from appropriately licensed professionals. Any decisions made based on Platform information are made solely at the user’s own discretion and risk.
7. Whole Life Insurance References (Educational Context Only)
The Site may reference planning concepts involving dividend-paying cash value whole life insurance as one potential long-term planning vehicle.
Any discussion of whole life insurance on this Site is: educational only, general in nature, not individualized to you, not a promise of performance, dividends, results, tax outcomes, or suitability
Life insurance policies contain costs, fees, conditions, and limitations. Policy values and benefits depend on policy design, underwriting classification, premium payments, insurer performance, and contract terms.
Not all individuals will qualify, and not all strategies are appropriate for all individuals.
8. Information You Submit
When you submit a Request through this Site, you may be asked to provide information such as: name, email address, state of residence, number of children being gifted, annual gifting budget per child, Additional information you voluntarily provide.
You represent and warrant that all information you submit is accurate and not misleading.
You understand that your submissions may be used for: routing your Request to a Practitioner, scheduling or follow-up communications, educational and administrative processing, internal platform analytics and quality control, compliance and recordkeeping purposes
9. Communication Consent
By submitting your contact information through the Platform, you authorize GGI and/or a Practitioner to contact you for purposes related to: scheduling educational conversations, responding to your requests, delivering educational content or appointment reminders.
Contact may include email, telephone, SMS/text, or other electronic methods, including the use of automated systems where permitted by law.
You are responsible for ensuring your contact information is correct. You may opt out of communications at any time by following the instructions provided in messages or emailing: info@generationalgifting.com
Nothing in this Section is intended to override your rights under applicable consumer communication laws.
9.1 Consent to receive communications is not a condition of purchasing any insurance product or service. Message frequency may vary. Standard message and data rates may apply.
10. No Guarantee/No Reliance
Your use of the Site is at your own risk. GGI makes no guarantees regarding: educational outcomes, insurance eligibility, financial results, acceptance or approval by any insurer, dividend performance, cash value performance, tax results, timing of communications, availability of Practitioners, the completeness, accuracy, or usefulness of content
You agree you will not rely on the Site as a substitute for individualized professional advice.
10.1 Assumption of Risk. You acknowledge and agree that your use of the Platform, including reliance on any educational information provided through the Platform, is at your sole discretion and risk. You assume full responsibility for any decisions you make, including any insurance, financial, or planning decisions, and you agree that GGI is not responsible for any outcomes resulting from your reliance on Platform content or any communications initiated through the Platform.
11. Site Content; Ownership; Intellectual Property; License Restrictions
All content on the Platform including text, visuals, videos, video scripts, educational materials, tools, structure, graphics, logos, layouts, other materials and design (collectively, “Platform Materials”) is owned by or licensed to GGI and protected by applicable intellectual property laws.
You are granted a limited, personal, non-exclusive, non-transferable, revocable license to access and use Platform Materials for personal, non-commercial educational purposes only.
You may not: reproduce, copy, republish, distribute, or sell Platform Materials, use Platform Materials to train third parties without written consent, create derivative works, scrape, data-mine, or use automated access methods, reverse engineer or attempt to access Platform code or infrastructure.
12. Prohibited Uses
You agree not to: use the Platform for unlawful purposes, attempt to access restricted systems or data, scrape, harvest, or mine data or user info, introduce malware, harmful code or viruses, use automated bots or scripts, interfere with security, performance, or operations, submit false information or impersonate others, use the Site for unlawful marketing, solicitations, or spam, misrepresent affiliation with GGI or the Platform or Site, violate privacy or confidentiality rights, interfere with Platform operations.
We may suspend or block access for suspected misuse.
13. Third-Party Links
The Site may link to third-party websites or services. Those third-party sites are not controlled by GGI. GGI is not responsible for third-party content, products, services, accuracy, or security. Links are provided for convenience only and do not constitute endorsements. Your use of third-party sites is at your own risk.
14. Privacy; Data Security
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
To operate the Platform and respond to your request, information you submit may be shared with authorized Generational Gifting Concept Practitioners and service providers who support Platform operations (such as hosting, scheduling, analytics, communications, CRM and security tools), subject to our Privacy Policy.
While we use reasonable safeguards, no method of transmission or storage is guaranteed to be 100% secure. You acknowledge that you provide information at your own risk.
15. Trademarks, Service Marks, and Logos
The trademarks, service marks, logos, URLs, domain names, trade dress, and other brand identifiers, whether registered or unregistered, appearing on the Platforms, including without limitation Generational Gifting Concept®, Generational Gifting Concept Foundation for Youth, and any related names, logos, slogans, designs, and combinations thereof (collectively, the “Marks”), are the exclusive property of Generational Gifting Inc. and are protected by applicable trademark, copyright, and other intellectual property laws.
No license or right is granted to you by implication or otherwise to use any Marks except as expressly authorized in writing by Generational Gifting Inc.
You may not use, copy, download, display, transmit, publish, modify, create derivative works from, distribute, or otherwise exploit any Mark without our prior written consent.
You may not register, purchase, reserve, or use any domain name, social media handle, advertising keyword, metatag, search term, or identifier that incorporates, imitates, or is confusingly similar to any Mark, or that may create an impression of affiliation, sponsorship, endorsement, or authorization by Generational Gifting Inc.
Unauthorized use of the Marks may violate trademark and other laws. Generational Gifting Inc reserves the right to take legal action and seek injunctive relief and damages upon discovery of any unauthorized use.
16. Disclaimers of Warranties
THE SITE AND ALL CONTENT AND MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND TO THE MAXIMUM EXTENT PERMITTED BY LAW, GGI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, ERROR-FREE OPERATION
We do not warrant or guarantee uninterrupted access or error-free operation of the Platform.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GGI (OR ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, PRACTITIONERS, LICENSORS OR AFFILIATES) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SITE OR ANY CONTENT, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE PLATFORM.
YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE IS TO STOP USING IT.
18. Indemnification
You agree to defend, indemnify, and hold harmless GGI and its officers, directors, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of: your use or misuse of the Site, your violation of these Terms, your breach of these Terms, your violation of applicable law, your submission of false or misleading information, your infringement of intellectual property or rights of others
19. DISPUTE RESOLUTION; ARBITRATION; CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration in the State of New York, except that GGI may seek injunctive relief in court to protect its intellectual property, trademarks, confidential information, or Platform security.
19.1 Notice and Informal Resolution First
Before filing any claim, you agree to provide written notice to info@generationalgifting.com and allow 30 days for informal resolution.
19.2 Mandatory Binding Arbitration (NY)
Except for claims eligible for small claims court, any dispute arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration in New York, New York, and not in court.
19.3 Class Action Waiver
YOU AND GGI AGREE THAT CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY ONLY. YOU WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION.
19.4 Injunctive Relief for IP / Security
GGI may seek injunctive relief in a court of competent jurisdiction to protect trademarks, confidential information, data security, or Platform integrity.
20. Governing Law; Venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
To the extent any dispute is not subject to arbitration, you agree that exclusive venue shall be state or federal courts located in New York, New York, and you consent to jurisdiction there.
21. Termination of Access
We may suspend, restrict, or terminate your access to the Site at any time, with or without notice, if we believe you violated these Terms or if we believe termination is necessary to protect the Platform, users, content, data, or compliance posture.
22. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date will reflect the most recent update. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
22.1 Platform Changes; Discontinuation. GGI may modify, suspend, or discontinue any portion of the Platform at any time, including features, content, forms, scheduling tools, or educational resources, without notice and without liability.
23. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
24. No Waiver
Failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
25. Assignment
GGI may assign or transfer these Terms, in whole or in part, without restriction. You may not assign these Terms without GGI’s prior written consent.

27. Force Majeure
GGI will not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including without limitation acts of God, natural disasters, failures of internet service providers, hosting providers, third-party platforms, utility interruptions, labor disputes, cyber incidents, governmental actions, or other events outside GGI’s reasonable control.
28. DMCA /Copyright Notice + Takedown Process
Copyright Infringement Notice (DMCA). If you believe content on the Platform infringes your copyright, you may send a written notice to info@generationalgifting.com with sufficient detail to identify the allegedly infringing material and your ownership claim. GGI may remove or disable access to allegedly infringing content in its discretion and in accordance with applicable law.
29. Survival
Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, and any other provisions that by their nature should survive, shall survive termination of these Terms.
30. Entire Agreement
These Terms, together with the Privacy Policy and any additional policies posted on the Platform, constitute the entire agreement between you and GGI regarding use of the Platform and supersede prior understandings related to this subject matter. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force.
